PLEASE READ THESE TERMS AND CONDITIONS OF USE (THE "TERMS") CAREFULLY BEFORE ACCESSING OR USING ANY WEBSITE, APPLICATION, OR SERVICE OPERATED BY OR ON BEHALF OF ADHDONE (COLLECTIVELY, "ADHDONE," "COMPANY," "WE," "OUR," OR "US"). THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU ("USER," "YOU," OR "YOUR") AND ADHDONE.
BY ACCESSING, BROWSING, OR USING THE SERVICES IN ANY MANNER, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY. IF YOU DO NOT AGREE TO ANY PROVISION OF THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SERVICES.
1. Definitions
"Services" means all websites, web applications, ADHD screening tools, contact forms, and any other digital services operated by or on behalf of ADHDOne. "Content" means all text, graphics, images, logos, trademarks, audio, video, software, code, data, and other materials displayed on or made available through the Services. "User Content" means any information, data, text, or materials submitted by you through the Services.
2. About ADHDOne
ADHDOne operates a network of locally branded psychiatric practices across multiple states. ADHDOne is a resource for individuals seeking ADHD evaluation and treatment. ADHDOne connects patients with locally branded psychiatric practices within our network for clinical care. ADHDOne does NOT provide medical care, diagnoses, or treatment directly.
3. Nature of Services; No Provider-Patient Relationship
THE CONTENT PROVIDED THROUGH THE SERVICES, INCLUDING ADHD SCREENING RESULTS, IS FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE MEDICAL ADVICE, PSYCHIATRIC ADVICE, DIAGNOSIS, TREATMENT, OR A RECOMMENDATION. The ADHD screener on this website uses the WHO Adult ADHD Self-Report Scale (ASRS v1.1 Part A), a standardized screening instrument. Screening results are NOT a medical diagnosis. Only a licensed healthcare provider can diagnose ADHD. Accessing the Services or submitting a contact form does not establish a provider-patient relationship.

4. Acceptance and Modifications
We reserve the right to modify these Terms at any time by posting the revised Terms with an updated "Last Revised" date. Your continued use of the Services constitutes acceptance of modified Terms.
5. Eligibility
The Services are intended for individuals at least eighteen (18) years of age. If you are under 18, a parent or legal guardian must use the Services on your behalf and agrees to these Terms on behalf of the minor.
6. Data Sharing Within Our Network
When you submit information through ADHDOne, it is shared with the local clinic brand in your area (part of our network) for the purpose of scheduling and providing clinical care. All locally branded clinics (such as Silver State Mental Health, Rise Higher, Triad MH Partners, and others) are part of the ADHDOne network. This is an internal transfer within our network -- your information is NOT shared with any third party.
7. Clinical Limitations
When you are connected with a local clinic in our network for clinical care, the following limitations apply to the services provided by that clinic:
(a) The clinic does not guarantee that any visit will result in a diagnosis. Visits are clinical assessments that may or may not lead to a diagnosis.
(b) The clinic does not guarantee that medication will be prescribed. Whether you receive medication depends on your clinical assessment, any diagnoses, and the provider's medical judgment.
(c) If medication is prescribed, the clinic does not guarantee that the medication will be available at your pharmacy or covered by your insurance plan. The clinic cannot guarantee the cost of any medication.
(d) If medication is prescribed, it is your responsibility to follow up with your pharmacy to ensure the prescription is processed. The clinic is not responsible for contacting the pharmacy on your behalf. If you have confirmed with your pharmacy that an issue remains, contact the clinic for assistance.
8. Privacy
Your use of ADHDOne is governed by our Privacy Policy, which is incorporated by reference into these Terms.
9. Intellectual Property Rights
All Content is the exclusive property of ADHDOne or its licensors, protected by copyright, trademark, and other intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to access the Content for personal, non-commercial use. Unauthorized reproduction, distribution, modification, or creation of derivative works from the Content is strictly prohibited.
10. Prohibited Conduct
You agree not to: violate any applicable law or regulation; infringe intellectual property rights; upload malicious software or code; attempt unauthorized access to the Services or related systems; interfere with or disrupt the Services; scrape, harvest, or collect data from the Services through automated means; impersonate any person or entity; or transmit spam, unsolicited messages, or other commercial communications.
11. SMS/MMS Communications
If you opt in to receive SMS/MMS text messages, you consent to receive autodialed or automated messages related to scheduling, follow-up, and care coordination. Reply STOP to opt out at any time. Message and data rates may apply. Consent is not required to receive services. Message frequency varies. For help, reply HELP or contact info@adhdone.com.
12. Third-Party Links
The Services may contain links to third-party websites or services. These links are provided as a convenience and do not constitute endorsement. We are not responsible for third-party content, privacy practices, or terms of use.
13. Disclaimers of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SCREENING RESULTS ARE NOT A MEDICAL DIAGNOSIS AND SHOULD NOT BE RELIED UPON AS SUCH.
14. Limitation of Liability
IN NO EVENT SHALL ADHDONE OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
15. Indemnification
You agree to indemnify, defend, and hold harmless ADHDOne and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from your use of the Services, violation of these Terms, or violation of any third-party rights.
16. Dispute Resolution and Binding Arbitration
ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") IN LARAMIE COUNTY, WYOMING. YOU AND ADHDONE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. Either party may seek injunctive relief for intellectual property or confidentiality matters.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws principles. For matters not subject to arbitration, you consent to exclusive jurisdiction in Laramie County, Wyoming.
18. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms or other reasons, without prior notice.
19. General Provisions
Severability: If any provision is held invalid, it shall be modified or severed and the remaining provisions continue in full force. Waiver: Failure to enforce any right is not a waiver. Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement. Force Majeure: We are not liable for failures beyond our reasonable control. Assignment: You may not assign these Terms; we may freely assign. Electronic Communications: You consent to receive electronic communications and agree they satisfy legal writing requirements. Survival: Provisions intended to survive termination will survive.
